ISLAMABAD: Three-member bench headed by Justice Nasirul Mulk hearing the petitions filed against the appointment of NAB Chairman removed the Imran khan’s plea in this connection.
Imran’s lawyer Hamid Khan argued that Chairman NAB appointment was the discretionary powers of President but he was out of sight in the appointment process, however court after hearing the arguments removed the petition.
In another petition Aitzaz Ahsan told court that the observation could not be dealt like verdicts, in response Justice Sarmad Jalal said that court had directed the action instead observation in NICL case.
Aitazaz Ahsan further said, in his arguments, that judges decision should be limited accordance to article 184(3) adding when judge took suo moto notice it caused the removal the basic right of appeal.
Justice Nasarul Mulk insisted either we take notices or constitution give the judge power? In response Aitzaz Ahsan said constitution was giving judge power and they exercised it.
